Theoretical analysis of jurisprudence as a science that has come true through the culture, history and civilization of Islam leads to a general theory about it. The general theory in the field of jurisprudence, regardless of the sect, subject and specific era, is called philosophy of jurisprudence. The quiddity of jurisprudent is explained and jurisprudential propositions are described in the philosophy of jurisprudence. The efficiency of the logic of jurisprudence is assessed from the methodological viewpoint that leads to the base of jurisprudence. The validity of the sources and reasons containing the legal law are also assessed. The relation and connection between jurisprudence and other sciences are presented and the way a jurist, in producing jurisprudential teachings, gets influenced by human and experimental sciences gets explained. Each of the abovementioned topics and other ones contains an important problem in the field of philosophy of jurisprudence. Debating the problems of philosophy of jurisprudence leads to a general and comprehensive view on jurisprudence in a way that affects the intra-jurisprudential studies of the jurist. فلسفة فقه از جمله شاخه‌های فلسفة مضاف است که در آن، فقه به‌معنای علم به احکام شرعی از ادلة تفصیلی آنها از منظر بیرونی و روی‌آورد معرفت درجة دوم، توصیف و تحلیل نظری می‌شود. تحلیل نظری فقه به عنوان علمی که در فرهنگ، تاریخ و تمدن اسلامی تحقق یافته است به نظریة کلی دربارة آن می‌انجامد. به نظریة کلی در زمینة فقه با قطع نظر از مذاهب یا باب خاص یا مقطع تاریخی معین، فلسفة فقه گفته می‌شود. در فلسفة فقه، ماهیت فقه تبیین و گونه های گزاره‌های فقهی توصیف می‌گردد و از منظر روش شناسانه، کارآمدی منطق فقه، سنجیده و مبنای فقه بدست داده می‌شود و جایگاه منابع استکشاف حکم شرعی تبیین می‌گردد. نسبت و رابطة فقه با علوم دیگر، ارائه و نحوة تأثیرپذیری فقیه در تولید معارف فقهی از علوم و معارف انسانی و تجربی، تحلیل و تبیین می‌گردد مباحث یادشده و دیگر مباحث، هریک متضمن مسئله‌ای مهم در زمینة فلسفة فقه است طرح مسائل فلسفة فقه به نگـرشی کلـی و جامـع نسبـت به فقه می‌انجامد به‌نحوی که در مطالعات درون فقهی فقیه مؤثر می‌افتد.
